Conditions of Purchase

These terms and conditions apply to every purchase of trading cards by Tobias Fricke, Albertus-Magnus-Straße 25, 31139 Hildesheim (hereinafter "we") from you as the seller. They are a component of every purchase contract concluded via our purchase page.

1. How the purchase process works

1. You send us a request via the form on our purchase page with the cards you wish to sell.
2. We review the request and send you a purchase offer via email with a specific amount. This offer is valid for 7 days.
3. If you accept the offer via email, you send us the cards.
4. We check the cards received. If the condition and quantity match your description, we will pay out the offered amount.

The price information on our purchase page and in our price tables is non-binding and does not constitute an offer. A contract is only concluded when you accept our individual purchase offer.

2. How we calculate prices

The basis for individual cards is the currently cheapest Cardmarket price for the respective card, taking into account the language and condition of your card. We pay between 75 and 80 percent of this; the exact amount depends on the liquidity of the card, i.e., how well and how quickly it can be resold.

We purchase cards in German, English, and Japanese. Other languages only by prior arrangement.

3. Bulk purchases

For cards with a copyright year of 2020 or older, we purchase at fixed prices per piece, regardless of the individual value:

Bulk cards are not valued individually. Please sort them into these three piles in advance and indicate the quantities in the form. We will count the cards upon arrival; our count is final.

4. What we do not purchase

• Cards with water damage, creases through the image area, missing corners, or mold infestation
• Written-on, taped, or trimmed cards
• Counterfeits and unlicensed reprints
• Cards to which you do not hold ownership

5. Minimum amount and limited purchase budget

The purchase value of a request must be at least €5.00.

We are a small, independent buyer with a limited budget. Therefore, we reserve the right to reject requests in whole or in part or to make an adjusted offer, for example, in the case of very valuable individual cards or large collections. There is no entitlement to a purchase.

6. Shipping to us

• You ship the cards at your own expense and risk, unless we inform you otherwise.
• We recommend insured shipping with tracking. We cannot be held liable for loss or damage during transit to us.
• Pack the cards securely for transport, placing individual valuable cards in sleeves and top loaders.
• Include a note with your name and your request number.

7. Inspection and discrepancies

We generally inspect the cards within 3 business days of receipt.

If the actual condition or quantity differs from your information, we will contact you with an adjusted offer. You then have 7 days to accept or reject it. If you reject it, we will return the cards to you at our expense. If you do not respond within this period, we will store the cards for you and return them to you at your expense as soon as you contact us.

Cards that we do not purchase according to section 4 will be returned to you together with the rest or disposed of at your request.

8. Payment

After acceptance of the offer, we will pay out within 3 business days, either by bank transfer or PayPal. You will provide us with your payment details upon acceptance of the offer. Any fees charged by the payment service provider are to be borne by you if they apply to your chosen payment method.

9. Your warranties

By accepting our offer, you warrant that

• you are at least 18 years old and fully legally competent,
• you are the owner of the cards and they are free of third-party rights,
• the cards do not originate from a criminal act,
• your information regarding condition, language, and quantity is accurate.

10. Sales tax

We are small business owners according to § 19 UStG and do not show sales tax. Please indicate in your request whether you are selling as a private individual or as a business — we require this information for our bookkeeping.

11. No right of withdrawal

In this purchase, you act as the seller. The statutory right of withdrawal for consumers in distance selling contracts does not apply in this case. Until our offer is accepted, you are not bound to anything and can withdraw your request at any time without formality.

12. Data protection

We process your data exclusively for the purpose of processing the purchase and fulfilling our tax-related record-keeping obligations. Details can be found in our privacy policy.

13. Final provisions

German law applies. Should any provision of these terms be invalid, the remainder shall remain unaffected.
